Terms of Reference
1.0 INTRODUCTION
1.1 Background
RCK invites interested and qualified applicants to provide consultancy services for a new project funded by UN Women-Kenya on “Enhancing Resilience and Protection of Women and Girls through Legal and Psychosocial Assistance and Awareness Creation in Turkana and Garissa Counties by April 2023”. Specifically, the project will be implemented in Kakuma Refugee Camp, Kalobeyei Integrated Settlement, Dadaab Refugee Camp and Garissa. The expected outcome and activities are set out here as here attached. The organization plans to hire two (2) legal consultants on consultancy basis to offer legal aid services to refugees and host communities as per its mandate. The consultants are expected to work closely with RCK staff in delivery of the project goals and objectives.

2.0 OBJECTIVES OF THE CONSULTANCY
The consultant shall:
i. Provide on a daily basis legal assistance and representation to refugees and host community, women and girls as per the organization’s mandate.
ii. Provide monthly reports on the status and legal protection needs of refugees’ women, girls and host community members.
iii. Represent refugees in courts of law and police stations.
iv. Participate in training and community forums for staff members, duty bearers and stakeholders on refugees, and host communities on protection and response to Sexual and Gender Based Violence (SGBV) cases.
v. Make appropriate referrals and recommendations to other agencies that work with RCK in refugee protection.
vi. Participate in community forums for duty bearers and Persons of Concern when called upon to do so.

3.0 DESCRIPTION OF TASKS
The tasks stated here will require the full availability of the consultant and may not allow other personal engagements during the assignment.
• Provide legal information and representation to primary beneficiaries of RCK at courts of law and police stations.
• Provide legal representation in courts of law for cases within RCKs mandate and with a focus on SGBV.
• Participate in training staff from CSOs, community based organizations and other relevant community structures on legal matters related to prevention of SGBV and support to survivors.
• Support in organization of psychoeducation forums targeting community members.
• Participate in development and distribution of IEC materials on SGBV prevention, response and refugee protection.
• Participate in organization of training session for court users’ committees, law enforcement and health professionals.
• Take lead in mobilization and training of translators to facilitate communication with women and girls at the legal aid clinics, courts of law and the police station
• Prepare legal briefs and studies on a variety of legal issues and instruments.
• Update and manage the client databases in RCKs systems.
• Prepare monthly reports and donor related reports within schedule.
• Such other duties temporarily or on a continuing basis, as may reasonably be required.
• Note, specific targets shall be shared at contractual stage.

4.0 EXPECTED DELIVERABLES AND OUTPUTS
The shortlisted consultants are therefore expected to provide the following deliverables:
Deliverable 1: Monthly work plan in line with RCK’s operations strategic plan and project objectives and targets as shall be agreed with RCK.
Deliverable 2: Monthly project progress implementation reports by 25th of every month as per agreed project targets.
Deliverable 3: Weekly reports that include court attendance reports, legal clinic reports, police station and other detention centers attendance reports, meeting reports and training reports.
Deliverable 4: Satisfactory quarterly and bi-annual consultancy reports as per the donor reporting dates and RCK operational requirements.
Deliverable 5: Satisfactory annual consultancy reports as per the donor reporting dates and RCK operational requirements.

5.0 CONSULTANCY TIME FRAME
The initial consultancy will cover a period of five (5) months, commencing on 01 November 2021.
However, it will be subject to renewal based on performance and availability of funds as supported
by the donor. The project is anticipated to end in April 2023.

6.0 REQUIREMENTS OF THE CONSULTANT
6.1 EDUCATION

  1. Bachelor’s degree in Law
  2. Advocate of the High Court of Kenya with a current practicing certificate.
  3. Provide certificate of good conduct.

6.2 EXPERIENCE

  1. Experience in protection and representation of women and girls’ protection (SGBV prevention and response).
  2. At least two years’ experience in civil and criminal litigation.
  3. Experience working with a non-governmental organization (NGO) or in the humanitarian field is an added advantage.

6.3 LANGUAGE:
Proficiency in English and Kiswahili

6.4 Behavior Competencies:
 Professionalism: In-depth theoretical knowledge of and significant experience in relevant fields of counseling, Strong analytical, problem solving and drafting skills. Discretion and sound judgment in applying counseling expertise to sensitive, children related matters,
complex legal and psycho social issues.
 Communication: Strong interpersonal and communication (written, spoken and presentational) skills.
 Technology Awareness: Fully proficient computer skills and ability to use relevant software applications, in particular information databases, internet/intranet services, library sources, etc.
 Teamwork: Ability to establish and maintain effective working relations with people of different national and cultural backgrounds with respect for diversity.
 Managing Performance: Ability to supervise, coach, mentor and develop junior staff as required.

7.0 REPORTING LINE

  • The consultants will report directly to the Programme Manager Dadaab/ Programme Manager Kakuma with support from the Senior Programme Officer.
  • The consultants shall work closely with Assistant Project Managers – Legal with peer lines to Assistant Programme Officers, Nairobi, Dadaab, Garissa and Kakuma.
  • He/She will refer any matters of the contract to Finance and Admin Office and the Human Resources Officer.
  • S/he may be assigned interns, volunteers, CBCs, translators and monitors.
