Consultancy N°1 ABA ROLI Consultant Team to build capacity of justice sector actors to prosecute and adjudicate money laundering, organized crime and terrorism financing cases.

Objective of this Request for Proposals

The assistance is aimed at training teams of prosecutors and judges who investigate and prosecute crimes related to money laundering, transnational organized crime, and financing of terrorism in the three countries.

The training will take place in three consecutive stages:

Stage 1: the consulting team will conduct 2 (two) 3-day training for judges and prosecutors in each country on the following topics:

  • Anti-money Laundering, Transnational Organized Crime and Countering the Financing of Terrorism (AML/TOC/CFT) international standards,
  • Target Financial Sanctions and techniques to prosecute and adjudicate these cases.

Stage 2: the consulting team will assist in the establishment of working groups for financial intelligent units and prosecutors to develop Standard Operating Procedures (SOP) and practical tools on:

  • sensitive evidence,
  • information sharing mechanisms,
  • charging decisions (including predicate offense applications to potential AML/TOC/CFT activity),

Stage 3: identify a cohort of Argentinian, Brazilian, and Paraguayan federal prosecutors and deliver AML/TOC/CFT advanced trainings of 180 hours of duration, synchronously and asynchronously (120 hours will be synchronous and 60 will be asynchronous)

Considering this the following deliverables have been stablished:

Stage 1

  1. Definition of training scope according to the needs of prosecutors and judges of the three countries. Time of Delivery: 30 days after signing the contract.
  2. Draft training contents and materials for each country showing. Time of Delivery: 60 days after signing the contract.
  3. Elaborate final reports containing the results of the training for prosecutors and judges in each country. Time of Delivery: 120 days after signing the contract.

Stage 2

  1. Elaborate a report containing the details of the Standard Operating Procedures (SOP) developed with the prosecutors and the FIUs of each country. The SOPs should be validated with the beneficiary institutions in each country. Time of Delivery: 180 days after signing the contract.

Stage 3

  1. Design first draft of training modules for the advance-level course for specialized prosecutors from the three countries on money laundering, organized crime and financing of terrorism related crimes. The 180 hours of training will be delivered synchronously and asynchronously (120 hours will be synchronous and 60 hours will be asynchronous). Time of Delivery: 30 days after finalized the trainings in Stage 1
  2. Final and approved version of training modules. Time of Delivery: 45 days after finalized the trainings under Stage
  3. Final report, on finalized training modules. Time of Delivery: 210 days after finalized the trainings under Stage 1.

Objetivo de esta Solicitud de Propuestas

Este llamado está dirigido a formar equipos de fiscales y jueces que investiguen y juzguen delitos relacionados con el lavado de activos, el crimen organizado y el financiamiento del terrorismo en los tres países.

La formación se desarrollará en tres etapas consecutivas:

Etapa 1: el equipo consultor realizará 2 (dos) capacitaciones de 3 días jueces y fiscales de cada país en los siguientes temas:

• Normas internacionales en anti-lavado de activos, contra la financiación del terrorismo y el crimen organizado transnacional (ALA/COT/CFT),

• Sanciones financieras específicas y técnicas para enjuiciar y adjudicar estos casos.

Etapa 2: el equipo consultor asistirá en el establecimiento de grupos de trabajo para unidades financieras inteligentes y fiscales para desarrollar Procedimientos Operativos Estándar (SOP) y herramientas prácticas sobre:

• evidencia sensible,

• mecanismos de intercambio de información,

• Decisiones de imputación (incluidas las aplicaciones de delitos predicados a posibles actividades ALA/ COT/CFT)

Etapa 3: identificar una cohorte de fiscales federales argentinos, brasileños y paraguayos e impartir capacitaciones avanzadas ALA/COT/CFT de 180 horas de duración, bajo modalidad sincrónica y asincrónica (120 horas sincrónicas y 60 horas asincrónicas)

Considerando esto se han establecido los siguientes entregables:

Etapa 1

1. Definición de alcances de capacitación de acuerdo a las necesidades de los fiscales y jueces de los tres países. Tiempo de Entrega: 30 días después de la firma del contrato.

2. Proyecto de contenidos y materiales de capacitación para cada país que se muestra. Tiempo de Entrega: 60 días después de la firma del contrato.

3. Elaborar informes finales que contengan los resultados de la capacitación de fiscales y jueces de cada país. Tiempo de Entrega: 120 días después de la firma del contrato.

Etapa 2

4. Elaborar un informe que contenga el detalle de los Procedimientos Operativos Estándar (POE) desarrollados con los fiscales y las UIF de cada país. Los POE deben ser validados con las instituciones beneficiarias de cada país. Tiempo de Entrega: 180 días después de la firma del contrato.

Etapa 3

5. Diseñar un primer borrador de módulos de capacitación para el curso de nivel avanzado para fiscales especializados de los tres países en delitos relacionados con el lavado de activos, crimen organizado y financiamiento del terrorismo.

Las 180 hs de capacitación se dictarán bajo las modalidades sincrónica y asincrónica (120 hs serán sincrónicas y 60 bajo la modalidad asincrónica)

Plazo de Entrega: 30 días después de finalizados los entrenamientos en la Etapa 1

6. Versión final y aprobada de los módulos de capacitación. Plazo de Entrega: 45 días después de finalizados los entrenamientos de la Etapa 1.

7. Informe final, sobre módulos de formación finalizados. Plazo de Entrega: 210 días después de finalizados los entrenamientos de la Etapa 1.

The American Bar Association – Rule of Law Initiative (ABA ROLI) is looking for 5 Short-Term paid consultants or a Consultant Team to conduct trainings, carry out roundtables, and develop guides and pocketbooks for Argentina, Brazil and Paraguay. These activities are intended to provide necessary tools to design and effectively develop anti-money laundering, countering transnational organized crime and terrorism financing (AML/TOC/FT) policies and monitoring strategies, as well as information sharing and jointly establishing the due process of adjudication and prosecution of cases related to ML/TOC/FT.
