Consultancy: Revision of Labour and Occupational Health Regulations requirement in Colombia At HelpAge International

Background

HelpAge currently has 8 employees in Colombia who are all on national contracts, working remotely with flexible daytime schedule.

Main Objective

To carry out a specialised consultancy for the review and compliance with the requirements of labour and occupational health regulations in Colombia, forlicalisation of IHA LAC Team from a Non-Profit Entity (ESAL) domiciled abroad to a local partner in Colombia.

Responsibilities

  • Review current practice with regard to staff working on non-working days and ensure in line with Colombia statutory requirements. Review the payment of overtime under the current modalities of work: Remote, flexible and daytime schedule.
  • Advice about the work condition under the flexible and remote modality in line with Colombian statutory requirements
  • Review the payment of travel expenses to ensure in line with Colombia statutory requirements.
  • Provide legal advice on the transition of current staff to another local entity.
  • Provide legal advice on the possible de- registration of the HelpAge office in Colombia.
  • Review contracts with suppliers, local partners, orders and contract for services and consultancies.
  • Provide other guidance on employment matters in line with Colombian law, including primas, cesantias and social security.

Deliverables

  • Joint work plan with actions, deliverables, dates and responsible parties, previously agreed with the Legal Representation in Colombia and the Humanitarian Programmes Manager, which will require the prior approval of the contract supervisor.
  • List of specific products to be delivered in the consultancy, including partial reports, legal concepts and other products related to the purpose of this consultancy, previously agreed upon with the Legal Representation in Colombia and the Humanitarian Programs Manager, which will require prior approval of the contract supervisor.
  • Final report with consolidated outputs, results achieved and recommended way forward, previously approved by the contract supervisor.

Supervision

The consultancy will be supervised by James O’Neil, Humanitarian Programmes Manager LAC.

Profile of the Firm and or individual person

  • At least 8 years of professional experience in compliance with labour laws and related regulations, including occupational hazards.
  • At least one senior consultant, a qualified lawyer with a minimum specialisation in labour law and 8 years of experience in the field.
  • At least one accounting-financial consultant, expert in payments, payroll, labour settlements and at least five years of experience in financial and accounting issues derived from the application of Colombian labour regulations.
  • At least one technologist with expertise in the specific areas of occupational health and occupational hazards.
  • Ability to provide information in English to HelpAge International representatives.
  • Ability to provide compliance policies as requested for this consultancy.
