CONSULTANT – ANALYSIS OF HARASSMENT AND DISCRIMINATION at American Bar Association

ABA ROLI is a non-profit organization that implements legal reform programs in roughly 50 countries around the world. ABA ROLI has nearly 500 professional staff working abroad and in its Washington, D.C. office. ABA ROLI’s host country partners include judges, lawyers, bar associations, law schools, court administrators, legislatures, ministries of justice, and a wide array of civil society organizations, including human rights groups.

The American Bar Association Rule of Law Initiative (ABA ROLI) seeks a consultant with expertise in social sciences, international development, human rights law, gender studies, or other relevant fields. The objective of this assignment is to provide technical support to the Judicial Services Commission (JSC) through a situation analysis of harassment and discrimination in the workplace, with respect to judicial staff in the Maldives.

DURATION AND SCOPE OF WORK

The Consultant is expected to spend up to 30 working days supporting the program during 2022. Consultants will support ABA ROLI and JSC by performing the following functions:

  • Conducting a desk review of harassment and discrimination in the judiciary over the past 10 years.
  • Conducting a field study to assess the situation of harassment and discrimination in the judiciary, in selected courts.
  • Preparing the initial and final reports.

ROLES AND RESPONSIBILITIES

  • Undertake a desk review of laws, policies and practices and actions related to harassment (including sexual harassment) and discrimination in the Maldivian judiciary over the last 10 years.
  • Prepare an inception report based on the desk review, to include findings, approach and methodology, implementation plan, key deliverables, milestones and timelines.
  • Conduct focus group and/or individual interviews with selected judges and judicial staff of varied ranks from selected islands.
  • Conduct a field survey of the selected islands’ courts to assess the extent of harassment (including sexual harassment) and discrimination in the Maldivian judiciary.
  • Recommend holistic approaches (both reactive and proactive) to deal with harassment (including sexual harassment) and discrimination in the judiciary (in consultation with the JSC).
  • Prepare an initial report, to include findings and recommendations.
  • Facilitate a validation workshop with JSC before finalizing the report.
  • Prepare a final report with findings on the extent of harassment (including sexual harassment) and discrimination in the Maldivian judiciary and holistic recommendations (both reactive and proactive) to address the issues.

REQUIRED QUALIFICATIONS

  • Master’s degree either in social sciences, international development, human rights law, gender studies, or other relevant fields
  • At least 5-8 years of professional experience in the field of gender equality, sexual harassment, gender mainstreaming, women empowerment.
  • Experience in reviewing laws, policies and document review.
  • Have a Clear and in-depth understanding of the social and gender issues in the Asia region.
  • Should have a clear understanding of the concepts of harassment and discrimination and, ideally, be familiar with the Maldives context.
  • Full computer literacy and fluency in English – both written and spoken – are essential.
  • Experience in working with international organizations.
