I. BACKGROUND

As part of the thematic area of Democracy, Governance and Labor Rights, PADF has a diverse portfolio of projects addressing labor rights challenges. We currently have projects dedicated to labor rights in Mexico, Guatemala, Honduras, El Salvador, Colombia and Brazil, among others. We work with the private sector, national and local governments, civil society organizations, unions and individual workers to advance these issues.
In February 2017, Mexico enacted historic constitutional reforms, which aim to transform its labor justice system into a more transparent and impartial system to effectively protect freedom of association and collective bargaining rights. In May 2019, the President of Mexico signed the necessary legislation to fully implement the 2017 constitutional reforms and prepare for the entry into force of the USMCA in July 2020, which would include a Chapter 23 for labor provisions.
Mexico’s labor reform calls for changes in the structure, administration and enforcement of labor rights, with a focus on freedom of association, collective bargaining, and the prevention of discrimination and violence in the workplace, thereby aligning the country’s legislation with international standards.
II. PROJECT DESCRIPTION
Within the framework of this reform and based on Chapter 23 of the USMCA, the project “Advancing Employer Compliance with Labour Laws in Mexico”, supported by the Government of Canada, seeks to strengthen and support the implementation of the relevant obligations and requirements in terms of compliance with labour practices in accordance with current labour legislation and the provisions of Chapter 23 and the Rapid Response Labour Mechanism (RRLM) of the USMCA, as well as the 2019 Labour Reform in the aerospace, automotive and electronic component manufacturing industries. Through awareness-raising, training and technical assistance activities, the project seeks the following results:
- Improving compliance with the principles of social dialogue and collective bargaining for employers in Mexico.
- Better compliance with labor laws for employers in Mexico.
- Policies and practices to promote gender equality in the workplace for employers in Mexico.
III. PLACE(S) OF ASSIGNMENT
The project has territories defined by states of the Mexican Republic and industries. For the aerospace and electronic components manufacturing industries, the diagnosis must cover the states of Aguascalientes, Nuevo León, Querétaro, Jalisco, State of Mexico, CDMX and Baja California. For the automotive manufacturing industry, the states include Aguascalientes, Jalisco and Baja California.
IV. TERMS OF REFERENCE, DELIVERABLES AND DELIVERABLE SCHEDULE (All applicable taxes, tariffs and other costs must be included in the price proposal.)
PADF is seeking a company or consultant to design a competency standard proposal for inclusion and evaluation in the National Registry of Competency Standards (CONOCER). The standard and certification would be aimed at human resources and labor relations professionals from manufacturing companies in the automotive, aerospace, and electronic components supply chains in Mexico.

VI. DETAILS OF THE SUBMISSION OF PROPOSALS
a. Deadline. Proposals must be received no later than 31 January 2025, 18:00 CDMX. Late proposals will not be accepted. Proposals must be sent by email to rcgutierrez@padf.org and evega@padf.org. All proposals must be submitted following the guidelines indicated in this RFP.
b. Validity of the offer: the proposals, including the cost/price, will be valid for 90 days from the submission deadline.
c. Clarifications. Questions can be sent to rcgutierrez@padf.org and evega@padf.org. The subject of the email must contain the RFP number and the title of the RFP.
d. Amendments. At any time prior to the deadline for submission of proposals, PADF may, for any reason, modify the RFP documents by means of an amendment which will be posted on the PADF website and/or communicated by email.

VII. MINIMUM REQUIREMENTS
What would be the minimum requirements for a successful tender?
- Based in Mexico.
- Knowledge of basic concepts and best practices for conflict resolution in the workplace (between employer/employee and worker/employee)
- Experience with competency standards and the certification process of the National Registry of Competency Standards (CONOCER)
VIII. PROPOSAL DOCUMENTS TO BE INCLUDED
- Signed cover page on the applicant’s letterhead and with their contact information.
- Technical proposal.
- Corporate capabilities, experience, past performance and 3 client references. Please include descriptions of similar projects or assignments and at least three client references.
- Key Personnel Qualifications: Please attach a resume demonstrating how the proposed team meets the minimum requirements listed in Section 7 (Minimum Requirements).
- Technical approach, methodology and detailed work plan. The Technical Proposal must describe in detail how the applicant intends to carry out the requirements described in the Terms of Reference.
IX. TERMS AND CONDITIONS
Result of Agreement
This RFP does not obligate PADF to execute a contract, nor does it commit PADF to pay any costs incurred in preparing or submitting proposals. Furthermore, PADF reserves the right to reject any and all offers, if such action is deemed to be in the best interest of PADF. PADF, in its sole discretion, will select the winning proposal and is not obligated to share the results of the individual evaluation.
Confidentiality
All proprietary information provided by the applicant will be treated as confidential and will not be shared with potential or actual applicants during the bidding process. This includes, but is not limited to, price quotes, cost proposals, and technical proposals. PADF may, but is not obligated to, post agreements on its public website after the bidding process has concluded, and the contract has been agreed upon. PADF’s evaluation results are confidential and applicants’ scores will not be shared with each other.
Protection from Sexual Exploitation and Abuse (PEAS)
As part of the Contractor’s internal controls and employee standards of conduct, the Contractor must ensure that its employees adhere to these standards of conduct in a manner consistent with the standards for United Nations (UN) employees in Section 3 of the UN Secretary-General’s Bulletin – Special Measures for Protection against Sexual Exploitation and Abuse (ST/SGB/2003/13).
Small, Minority and Women-Owned Businesses Contracting
PADF will take all necessary steps to ensure that minority-owned businesses, women-owned businesses, and businesses in areas with surplus labor are utilized whenever possible.
Disqualification and suspension
Entities that appear on any exclusion list, System for Agreement Management (SAM), Office of Foreign Assets Control (OFAC), United Nations Sanctions List, and other watch lists will not have their offer evaluated and will not be eligible to receive any subagreements that may result from this Request for Proposals.
