Context:

Context:

Upholding the protection of the rights of irregular migrants, failed asylum seekers and other persons subject to readmission to Iraq while fulfilling the international obligation to readmit own nationals is of critical importance for strong migration cooperation between Iraq and other countries. This is highlighted by the National Migration Management Strategy which identifies developing migration governance and legal frameworks as one of its four strategic objectives and by the decision of the inter-ministerial Technical Working Group on migration to establish thematic taskforces to address legal frameworks as well as return migration.

IOM promotes migration policies and legislation which are coherent, comprehensive, and in line with national priorities and current migration realities, and which correspond to international norms and good practices. In the area of policy and legislation development, IOM provides assistance to the Government of Iraq in capacity building and research in migration policy and legislation development in accordance with Iraq’s national policies and priorities, international standards and best practices in the area of international migration law, and support to the government in acceding to and implementing the international and regional instruments related to migration and migrants’ rights.

The Migration Strategy recommends a comprehensive lessons-learned review of existing legislation, migration cooperation agreements and arrangements and policies, conducted with a view to formulating actionable recommendations for future migration cooperation between Iraq and other countries and considering legal obligations and opportunities under relevant national and international law, including the EU-Iraq Partnership and Cooperation Agreement and the Global Compact for Migration, and possible gaps identified in the legal framework.

Core Functions / Responsibilities

This consultancy will be undertaken within the framework of the Dutch funded “Cooperation on Migration and Partnerships to Achieve Sustainable Solutions (COMPASS)” project, which is implemented by IOM with the overall objective of improving migration governance in Iraq. Specifically, the consultancy will contribute to achieving Output 3.1: Detailed reviews of each implementation country’s migration governance policies, programmes, legislation, and practices are available and inform structural level programming.

Scope of the Assignment:

Building upon Iraq’s Migration Governance Indicators assessment, the results of a gap analysis of Iraq’s national legislation, and a review of its regional and international agreements, the incumbent will conduct a more detailed review of Iraq’s migration governance policies and practices on return, readmission, and reintegration, and develop a roadmap and recommendations to streamline national practices and policies with international standards and agreements and inform structural level programming. To draft the roadmap and obtain government ownership and validation of the process and its, joint workshops will be held with relevant government stakeholders, through the inter-ministerial Technical Working Group and its Legal Frameworks and Return Migration Taskforces.

Responsibilities:

Under the overall supervision of the Chief of Mission (CoM), technical guidance of the Head of the Migration Management Unit and direct supervision of the Programme Officer (Migration Governance), the successful candidate will:

· Conduct a detailed review of Iraq’s migration governance legislation, policies, MOUs and practices on return, readmission, and reintegration, including a roadmap and recommendations to streamline national practices and policies with international standards and agreements.

· Facilitate a validation exercise in a workshop with relevant government stakeholders, through the inter-ministerial Technical Working Group and Legal Frameworks and Return Migration Taskforces.

· Coordinate as appopriate with MMU activities on addressing identity management, including through technical advise on legal matters.

Methodology:

The methodology must guarantee inclusive participation of all the stakeholders involved. Coordination with the IOM Office in Iraq shall be ensured throughout the process, particularly regarding in-country consultations. IOM will provide outreach support to key stakeholders.

Timeline:

The assignment is expected to be conducted before the end of 2021. The timeline is subject to changes based on the agreement between IOM and the Consultant.

Required QualificationsInternational Organization for Migration

IOM is seeking applications from individual consultants and/or consortiums of individual consultants with the following qualifications and experience:

Education

· Master’s degree in Law or International Law, or a related field from an accredited academic institution with at least 7 years of relevant professional experience; or

· University degree in the above fields with at least 10 years of relevant professional experience.

Experience & Skills

· At least 7 years of experience with working on issues of migration law or return migration;

· Experience in legislative reviews is an asset;

International Organization for Migration· Strong understanding of the international migration dynamics, legislation and policies in Iraq;

· Proven research experience and ability to write analytical reports in English;

· Proven experience in facilitating meetings with government stakeholders;

· Excellent critical thinking and writing skills;

· Ability to produce quality work accurately and concisely according to deadlines;

· Ability to work effectively and harmoniously in a team of colleagues of varied cultural and professional backgrounds.

Languages

  • Fluency in English is required.
  • Arabic or any other language is an advantage.
