The Carter Center is a non-profit, non-partisan, non-governmental organization guided by a fundamental commitment to human rights and the alleviation of human suffering. The primary objective of the Center in the DRC is to promote democracy, respect for human rights, and transparency and accountability in the management of natural resources. The Extractive Industries Governance Program aims to ensure that the exploitation of the country’s immense natural resources contributes to the sustainable development of present and future generations of the Congolese population.

In March 2018, the revised mining code established a sovereign fund dedicated to future generations, called the Mining Fund for Future Generations (FOMIN), which must be funded by the 10% quota of the mining royalty. The institution of FOMIN is an important step towards the contribution of the mining sector to sustainable development in the DRC. However, the challenges related to the management and operationalization mechanisms of FOMIN may hinder the achievement of this objective of contributing to sustainable development in the country.

Thus, with the support of the Fiscal Transparency Innovation Fund (FTIF) of the State Department and the Embassy of the United States of America in Kinshasa, the Makuta ya Maendeleo Consortium (made up of the Carter Center and 6 other civil society organizations) [1] intends in particular to facilitate the development, adoption and implementation of a management strategy for FOMIN in order to respond to the spirit of the revised mining law. This strategy will serve as a guide and policy in the use of funds and in ensuring transparency and accountability mechanisms for FOMIN’s agents. The Makuta Consortium plans to build a consensus among all stakeholders in the process of developing and adopting such a strategy so that FOMIN is a real lever for sustainable development beneficial to future generations in the DRC.

Pour faciliter ce processus, le Centre cherche un(e) consultant(e) individuel(le) hautement qualifié(e) pour accompagner le Consortium Makuta ya Maendeleo dans le processus d’élaboration et de validation de la stratégie nationale de gestion du FOMIN.

Début du Contrat : Dès que possible

Lieu : À distance (à cause des restrictions de COVID-19)

Durée de Consultance : Prévu à trois mois

Responsabilités et livrables :

§ Fournir des conseils et une expertise technique pour mettre à jour et améliorer l’analyse du cadre légal et institutionnel du FOMIN au regard des principaux fondamentaux et de bonnes pratiques en matière de gestion des fonds souverains

§ Apporter l’appui pour finaliser l’analyse comparative entre le FOMIN et d’autres fonds souverains en Afrique, en particulier le Pula Fund du Botswana, le Ghana Heritage Fund, et le Ghana Infrastructure Investment Fund et tout autre fonds sélectionné.

§ Apporter un soutien pour l’élaboration de la stratégie nationale d’intervention du FOMIN

§ En fonction du temps disponible, participer dans les consultations et les échanges avec les parties prenantes notamment au sein des plateformes multipartites sur le processus d’amélioration et de validation du projet de stratégie d’intervention du FOMIN

§ Contribuer à l’amélioration du projet de stratégie d’intervention du FOMIN en fonction des amendements formulés par les parties prenantes.

Compétence requise et profil des candidat(e)s consultant(e) :**

§ Une excellente maîtrise de règles et pratiques de gestion des fonds souverains à travers le monde, en particulier en Afrique

§ Connaissance parfaite du secteur minier congolais, en particulier la législation minière révisée

§ Connaissance de la législation et des politiques des finances publiques de la RDC

§ Expérience précédente dans la conduite d’au moins un processus similaire dans le secteur extractif avec la présentation d’un rapport précédent

§ Capacités avérées de communiquer en public et de faciliter les échanges entre divers acteurs, incluant les représentants de l’Etat, les entreprises minières, les acteurs de la société civile, les chercheurs académiques, etc

§ Maîtrise parfaite du Français, la connaissance de l’Anglais est un atout
